- Story Text: U.S. army's 1st Armoured Division based in Germany
continues an investigation against an army captain charged
with killing of Iraqi man in May.
Capt. Rogelio M. Maynulet was seen entering a court
in the southern German town of Hanau, outside Frankfurt, on
Friday morning (September 10, 2004).
Maynulet is "charged with murder and dereliction of
duty for the suspecting killing of an Iraqi male on May 21,
2004," according to a 1st Armoured Division news release.
"The charges stem from an incident in which U.S. Forces
near Kufa (Iraq) came into contact with a black sedan
believed to contain militia forces," the written statement
said.
"A chase began and U.S. Forces shot at the vehicle. The
driver and passenger were killed. Shortly thereafter, the
wounded driver was shot at close range," the statement
continued.
The investigation began in Iraq and then adjourned
until the redeployment of the 1st AD (Armoured Division)
was completed. The Armoured division is now based in
Germany.
The Article 32 investigation was originally scheduled
to be held from Sept. 8 -10, 2004. An army spokesman on
Friday said one more day of hearing had been added, Monday
(September 13).
According to a 1st Armoured Division news release, an
Article 32 is "a formal and impartial investigation
required before a case that may be referred to a general
courts martial. The title refers to Article 32 of the
Uniform Code of Military Justice (UCMJ)."
"The investigation includes an inquiry as to the truth
of the charges, consideration of the form of the charges,
and recommendation what should be made of the case in the
interest of justice and discipline," the statement
continues.
"Many times it is likened to a civilian grand jury but
unlike the civilian proceeding, the accused has the right
to attend and participate. The accused is given full
opportunity to cross-examine witnesses against him and to
present anything he may desire in his own behalf," the
statement said.
