- Story Text: The U.S. Army's 1st Armored Division based in
Germany has reconvened a so-called Article 32 investigation
against an army captain charged with killing an Iraqi man
earlier this year.
Capt. Rogelio M. Maynulet appeared in court in the
southern German town of Hanau, outside Frankfurt, on
Wednesday (September 8), "charged with murder and
dereliction of duty for the suspecting killing of an Iraqi
male on May 21, 2004," according to a 1st Armored Division
news release.
"There are several different ways that this can turn
out," U.S. army major Michael J. Indovina told reporters
after the first day of the reconvening and the recess in
July.
"It could be an Article 32 investigation, it could be
recommended that it could go to a court martial, it could
be some non-judicial punishment that could be taken or it
could be
dismissed. It totally depends on what the recommendation is
from the investigating officer," Indovina said.
"The charges stem from an incident in which U.S. Forces
near Kufa (Iraq) came into contact with a black sedan
believed to contain militia forces," the written statement
said.
"A chase began and U.S. Forces shot at the vehicle. The driver and
passenger were killed. Shortly thereafter, the
wounded driver was shot at close range," the statement
continued.
"The investigation began in Iraq and then adjourned
until the redeployment of the 1st AD (Armored Division) was
completed. The Article 32 investigation is scheduled to be
held from Sept. 8 -10, 2004.
