00.00.13 AFTERMATH AT HOUSE OF KWAMAKUTHA KILLINGS JANUARY 1987
00.04.31 GENERAL MALAN ATTENDING MILITARY PARADE & HANDING OUT MEDALS IN POTCHEFSTROOM
00.09.48 TRUTH COMMISSION [28/08/96] MRS NTHULI [WIDOW OF VICTOR NTHULI] TESTIFYING ABOUT THE KWAMAKUTHA ATTACK: After the attack there were many things that occurred...what hurt me and what was most painful to me, I lost hope in our Law in the Court of Law.
00.10.12 SYDNEY MUFAMADI [MINISTER OF SAFETY & SECURITY] PRESSER [29/10/95] Following the investigations conducted...the Attorney-General has ordered the arraignment of the following persons on murder charges relating to the killing of 13 persons in Kwamakutha on 21/01/87: General Magnus Malan former Minister of Defence.
00.10.46 These individuals will be formerly arrested by a team of detectives...at the Durban Regional Court on Thursday...bail conditions have been agreed upon.
00.11.15 Hitsquads will not be tolerated by the Government of National Unity & the SAPS. They will be investigated, exposed & prosecuted in the Courts. A serious effort has to be made to end the violence in Kwazulu-Natal & other affected areas. The prosecution of hitsquads is a step in that direction.
00.11.49 REACTION GENERAL CONSTAND VILJOEN [LEADER FREEDOM FRONT] [30/10/95] I think in a way this might consolidate the divided Afrikaner because the Afrikaners are generally people that believe in their generals because the generals have never been political - in fact they have been mold under the political system of the National Party before and now they're again mold under the political system of the ANC government at the moment.
00.12.08 REACTION FW DE KLERK [LEADER OF NATIONAL PARTY] [30/10/95] I'm shocked. I have the highest respect for the top generals involved, for Minister Malan as well & I as former Head of Government will stand by all my people not just the generals, but all my people, by all those who fought on the side of the security forces against insurgence with regard to their actions within the farmework of decisions which were taken by the government & the policy of the government to fight terrorism where ever it occurred.
00.12.43 We've negotiated and it's Law of this country in the Constitution there will & must be amnesty for all people who participated in the political conflict even if they have committed crimes because a political motive was involved. This must now be applied in an evenhanded manner and I therefore believe that the solution for this case...is that temporary immunity should be looked at to create time & space for the Truth Commission to perform its task...
00.13.27 It is incorrect if there is any impression of selective trials now being pushed because then we are having a witch-hunt now & that must be prevented at all costs.
00.13.43 REACTION MANGOSUTHU BUTHELEZI [LEADER OF THE INKATHA FREEDOM PARTY] [30/10/95] It seems to me that there are no evenhandedness because quite clearly everyone knows that the ANC was committed to an armed struggle and we know that during that armed struggle a lot of people were killed.
00.13.55 GENERAL MALAN & OTHERS APPEAR IN DURBAN REGIONAL COURT ON MURDER CHARGES [02/11/95] EXTERIORS COURT

00.15.19 MALAN COMING OUT OF COURT
00.15.45 GROUP OF PEOPLE SHOUTING
00.15.58 MALAN: I'd like to say that I am a moderate. I believe that the values of family life should be protected, the values should be maintained. I'm a democrat and I believe in the democratic development of SA but above all I am a Christian and I'm very proud of it. But what is happening here today is causing the biggest crisis that's ever been in the democracy of SA. SA's democracy is moving into a dark hour, the darkest ever.
00.17.01 MALAN GETTING INTO VEHICLE
00.17.11 CROWD OF ANGRY BLACKS SURROUNDING COMBI
00.17.23 LEAVING OUT GATES - STRONG POLICE PRESENCE
00.17.28 REACTION MANDELA [21/11/95] I would like to leave everything to the courts because people still have an opportunity of making an application to the Court if they so desire...for their cases to be suspended until they approach the Truth Commission.
00.17.52 GENERAL MALAN ADDRESSING FCA [28/11/95] I and othe members of the top echelon of the SADF appeared in the Durban Magistrate's Court on 2/11/95 on the charge of murdering 13 people. Apparently this despicable deed, the killing of 13 innocent people including children was committed during January 1987. We were charged with this contemptible act and to date have not received any formal charge sheets.
00.18.29 I have no knowledge of the circumstances & details of the atrocity that took place approximately 9 years ago. I do know my conscience is clear.
00.18.44 As the Minister of Defence I took the political responsibilty for all the actions taken by the SADF to defend our country in those prevailing circumstances...the SADF never lost in battle and this paved the way for negotiations...peace became a reality...
00.19.23 ...the SADF has so many times been wrongly accused as the so-called defenders of Apartheid...
00.19.47 ...my co-accused the top echelon of the SADF, assisted the SADF's mission that democracy should be established by evolutionary means and not by a revolution...
00.20.16 I would like to put on record that I don't know of any hitsquads that has been trained or that has existed within the SADF, not during my time.
00.20.34 I never saw, I never discussed, I was never informed about any so-called hitlist because if you have a hitsquad you've got to have a hitlist and that hitlist must be approved. Hitsquads the duty of them or their mission - they are there to assassinate leaders of opposing forces, that's their mission. That type of action is directly in contrast to the mission, task & existence of the SADF.
00.21.23 I know of no weapons that I approved that has been supplied to Inkatha. It might be that a government agency from SA has supplied a weaponry to the Kwazulu-Natal government but supplying to local organisations I know nothing about.
00.21.59 Whether I'm prepared to appear in front of the Truth Commission? Well, I havn't got really anything that I can think of that I can confess, but if the Truth Commission should ask to have more detail on certain things & I feel that on the actions or decisions that I've taken at the time, I have to confess on then I'm quite prepared to it.
