- Date: 28th December 2023
- Summary: SOUTH BEND, INDIANA, UNITED STATES (DECEMBER 28, 2023) (REUTERS) NOTRE DAME LAW SCHOOL, PROFESSOR OF LAW, DEREK MULLER, SAYING: “So the Colorado Supreme Court's decision on December 19th was a major one, right? It's a decision from the highest state court disqualifying a candidate from the ballot. That has never happened before in American history. Those instances that arose in the sixties and seventies were dealing with candidates who were maybe ejected from their office or just barred once they presented their credentials. But the state began printing the ballot in the 1880s and 1890, so excluding candidates from the ballot is a newer thing, if you will. And even a year ago, when a New Mexico County official was found guilty of trespassing in the Capitol for his role in the January 6th attacks, he was ejected from office. This is very different. This is saying your name can't even appear on the ballot. First time it’s ever happened in American history, much less to a presidential candidate or to a former presidential candidate or the frontrunner for his party's nomination, not just a third party or independent bid.” SCREENSHOT OF FRONT PAGE OF RULING BY COLORADO SUPREME COURT DISQUALIFYING FORMER PRESIDENT DONALD TRUMP FROM THE BALLOT IN THE STATE’S PRESIDENTIAL ELECTION SCREENSHOT OF SECTION OF THE RULING READING: “The sum of these parts is this: President Trump is disqualified from holding the office of President under Section Three, because he is disqualified, it would be a wrongful act under the Election Code for the Secretary to list him as a candidate on the presidential primary ballot.” SOUTH BEND, INDIANA, UNITED STATES (DECEMBER 28, 2023) (REUTERS) NOTRE DAME LAW SCHOOL, PROFESSOR OF LAW, DEREK MULLER, SAYING: “The dispute is actually filed originally by plaintiffs in Colorado against the Colorado secretary of state, saying you need to keep Trump's name off the ballot. At that moment, Trump and the Colorado Republican Party intervened as parties to say, well, hold on a second before you go keeping my name or our candidate's name off the ballot, we want to be a part of this litigation as well. So on December 27th, the Colorado Republican Party filed that first petition for a (inaudible) with the United States Supreme Court. The Trump campaign is expected some time, if I had to guess probably early next week to file its appeal as well for the Supreme Court to take the case. And again, I think the fact that the Colorado Supreme Court has stayed its decision until January 4th and will let him appear on the ballot even after that, if there's an appeal pending means that he probably will be on the ballot and we'll let this play out over the next several weeks.”

- Story Text: The Colorado Republican Party on Wednesday (December 27) asked the U.S. Supreme Court to intervene after Colorado's top court disqualified former President Donald Trump from appearing on the state's Republican primary ballot, an attorney for the Republican group said.
The appeal comes after the Colorado Supreme Court on Dec. 19 disqualified Trump because of his role in the Jan. 6, 2021 attack on the U.S. Capitol by his supporters. The court barred Trump under a U.S. constitutional provision prohibiting anyone who "engaged in insurrection or rebellion" from holding public office.
Also on Wednesday (December 27), Trump scored a victory in his fight against challenges to his eligibility to run for the White House again when Michigan's top court declined to hear a case seeking to disqualify him from the state's presidential primary ballot.
The Michigan Supreme Court said it would not hear an appeal from four voters in the state seeking to bar the former president from the Feb. 27 Republican primary for his role in the Jan. 6, 2021, attack on the U.S. Capitol.
Maine's secretary of state Shenna Bellows is expected to issue a decision on Trump's 14th amendment ballot eligibility in the coming days.
