- Story Text: Lindsay Lohan is facing a new DUI charge. The 21-year-old actress was arrested early Tuesday (July 24) morning on suspicion of driving drunk in Santa Monica. Police say they responded to a distress call from a female driver in a black Cadillac Escalade who said she was being pursued by a white Yukon near city hall.
"At 1:35 this morning, our department received a phone call from a woman who was driving her car being chased by another vehicle," Lt.
Alex Padilla of the Santa Monica Police Department told Reuters. "Turns out that the vehicle, they ended up about a block away from the police department. When our officers arrived, it turned out that the vehicle that was being chased was being driven by the mother of Lindsay Lohan's personal assistant. The car that was chasing them was being driven by Lindsay Lohan."
Police say when they arrived on the scene, the drivers of both SUVs were standing outside their cars arguing. One was confirmed to be Lohan. Two male friends were also riding in the vehicle driven by the actress. Officers briefly detained the pair for questioning. They then tested Lohan determine whether or not she had consumed a quantity of alcohol above the legal limit before getting behind the wheel.
"Lindsay Lohan was driving the vehicle and she had been driving the vehicle under the influence of alcohol," Lt. Padilla stated.
"They had her complete a full sobriety test which she did not pass. At that point they brought her here to the jail where she submitted to a blood alcohol test. The levels came back to to .12 and .13 percent, so she was charged with driving under the influence. During the booking process we also found a small amount of cocaine in her pockets, so she was also charged with possession of a controlled substance. She has since posted bail and she was released 6:20 this morning."
Police say Lohan was cooperative during the arrest.
Officers also confirmed for reporters that Lohan's personal assistant was in the SUV being chased by Lohan, and that the young woman had just quit her job hours earlier.
The actress, who stars as a stripper abducted by a sadistic killer in her latest film, "I Know Who Killed Me," already faces a drunken-driving charge following a car crash in Beverly Hills two months ago.
Her arrest and apparent return to rehab forced the cancellation of a planned appearance Tuesday (July 24) on NBC's "The Tonight Show with Jay Leno" to promote the new movie, which opens Friday (July 27).
Lohan just finished 45 days in an alcohol-treatment program. As part of her out-patient care, she had agreed to wear an alcohol-detecting device on her ankle.
The actress's attorney, Blair Berk, released a statement acknowledging that her client had relapsed. Berk also noted that "the bracelet has now been removed" and "she is safe, out of custody and presently receiving medical care."
When asked what the next step for Lohan will be, police were not able to provide specifics.
"She was released, she posted bail, and she will appear back in court," said Lt. Padilla. "Probably in a couple of weeks with her attorneys and at that point the district attorney and her attorney will present their case to the judge and the decisions will be made."
According to the court, Lohan's arraignment for these charges has been scheduled for August 24 at 8:30 a.m. in Santa Monica, the same day she is scheduled to appear in a Beverly Hills court for her Memorial Day weekend DUI arrest.
Her recent stint at Promises Treatment Center in Malibu was her second time in rehab in less than a year. Just last Friday, Lohan turned herself in to Beverly Hills police to face charges of drunken driving and leaving the scene of an accident in connection with a May 26 car crash. In that case, she lost control of her Mercedes-Benz sports car and drove into a hedge. She then left the scene. Police said at the time they also found a small amount of what they believed to be cocaine in the car.
In January, she checked into the Wonderland Center in Laurel Canyon after allegedly passing out in a hotel hallway following a party thrown for the Golden Globe Awards. - Copyright Holder: REUTERS
